2. User Age

• 2.1 The Services are not intended for individuals under the age of eighteen (18) (or the legal age of majority in the user’s country). If you have not yet reached 18 (or the required age in your country), you cannot register for or use the Services. If we learn that you provided false information about your age during registration, we will revoke your registration or subscription immediately and discontinue providing the Services.

3. Registration and Subscription to the Services

• 3.1You may register or subscribe to the Services offered on the Website from time to time.

4. Term & termination

• 4.1 Registration becomes effective once the sign up process is completed.
• 4.2 These Terms of Use remain in force for as long as you use the Site or Services.
• 4.3 You may cancel at any time by emailing info@essensitive.com or calling +39 024 776 7244; we will confirm your cancellation.
• 4.4 Essensitive may suspend or terminate accounts at its discretion in the event of material breach, notifying you by e mail or post.

5. Electronic services

• 5.1 Parts of the Services may be delivered via electronic communications (e mail, SMS, phone).
• 5.2 You agree we may contact you by these means and acknowledge that your carrier may charge fees.

6. Intellectual property rights

• 6.1 “Site” and “Materials” include – without limitation – all design elements, software, layout, photography, text, audio, video, trademarks, trade dress and other content displayed.
• 6.2 All Materials are protected worldwide and owned exclusively by Essensitive; all rights are reserved.
• 6.3 Trademarks, trade names and domain names on the Site are owned or licensed by Essensitive.
• 6.4 The Site is provided solely for private, personal, non commercial use. No Material may be copied, reproduced, published, distributed or modified – in whole or in part – without prior written consent, save for personal use.
• 6.5 Downloading or copying, where expressly permitted in writing, confers no rights in the Material.
• 6.6 Essensitive rigorously enforces its IP rights; any unauthorised use is prohibited.

7. Submitted material

• 7.1 Any idea, design, concept, photograph or other content you send to Essensitive (“Submitted Material”) is deemed non confidential. You grant Essensitive a worldwide, royalty free, non exclusive licence to use such material for advertising, promotional or product development purposes for the entire legal term of protection.
• 7.2 Essensitive is under no obligation to keep Submitted Material confidential, compensate you or respond to you.
• 7.3 You warrant that Submitted Material does not infringe third party rights.
• 7.4 Essensitive may refuse or remove Submitted Material at its discretion.
• 7.5 Essensitive Srl reserves the right to refuse or remove any Submission for any or no reason, including Submission that in our judgment violates these Terms of Use or that may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity.

8. Links to third party sites

• 8.1 Essensitive is not responsible for external websites linked to or from the Site.
• 8.2 Hyperlinks do not imply endorsement.
• 8.3 Framing or linking any part of the Site without prior written consent is prohibited.

9. Authenticity of Essensitive products

• 9.1 All Essensitive products promoted on this Site are crafted from the finest materials and proudly MADE IN ITALY.

10. Disclaimer of warranties

• 10.1 To the fullest extent permitted by law, the Site, its content and Services are provided “as is” and “as available”, without warranties of any kind. Essensitive does not warrant uninterrupted, error free or virus free operation, or fitness for a particular purpose.
• 10.2 While Essensitive strives for accuracy, it does not guarantee that information is error free or complete and reserves the right to correct content without notice.

11. Limitation of liability

• 11.1 Certain jurisdictions do not allow every aspect of the following exclusions or limitations. Where mandatory law restricts a clause, that clause will apply only to the extent permitted.

Any dispute arising from or connected with these Terms shall be submitted to the exclusive jurisdiction of the Italian courts, or, where required by applicable law, to the courts of your country of residence.
